8th circuit denies Noem (again) backs Kornmann 11/3/21 decision on Initiated Law Petitions. Medicaid expansion, Marijuana, you name it!

WHAT YOU NEED TO KNOW

On November 3rd 2021, Federal Judge Charles B Kornmann rejected Governor Noem’s request to stay his August ruling that grassroots activists could continue to collect signature for Initiated Measures until May 3rd 2022.


On December 12th 2021, Governor Kristi Noem, Attorney General Jason Ravnsborg, and South Dakota Secretary of State Steve Barnet appealed Judge Kornmann's November 3rd decision to the United States Court of Appeals for the 8th Circuit.


On January 6th 2022, the 8th Circuit denied their request to stay the ruling of the lower court and that means more Democracy for all of us!

I thought the signature deadline passed already?

The deadline for Constitutional Amendment Petitions was November 8, 2022. However, Judge Charles B. Kornmann recently extended the deadline to collect signatures for Initiated Law Petitions through May of 2022.


I already signed the Medicaid expansion petition?

Not this one. The petitions you signed previously were for the Constitutional Amendment. This is for an Initiated Law. Initiated laws tend to garner more votes which will be critical in case the SD Legislature passes Amendment C which seeks to impose a 60% threshold to laws like Medicaid expansion and Medical marijuana.
